Testimony regarding Clackamas County Elections Fraud
At Saturday's meeting Cindy Tyree shared with us regarding the 66/67 mail piece sent out by Clackams County using public funds and work time by public employees. The postcard was clearly skewed to convince voters to support 66/67 tax measures. This was clearly against state law and is misappropriation of public funds. Cindy and a friend will be testifying Thursday morning and will appreciate your support.
Below are the details, letters, minutes from meetings and copy of the postcard in question. We urge you to support them with your presence and/or if possible your 3 minute testimony.

(the most frustrating part is the G. Schmidt mentioned as being in
attendance... His name is Gary Schmidt and supposedly is a Republican
that knows some folks at the Clackamas County Republican Party. Did he
tell anyone at the CCRP about this back in December - or earlier - I
doubt it, or else we could have acted - like filing a court injunction
or something.)

I (Cindy Tyree) am holding a press conference on Thursday morning at 11:00 am in front of the commissioner's office in Oregon City.
For those of you who ask "What can I do?" or "How can I help?", this is your chance to do something really simple but very significant. I need you to come stand with me as I inform the media that I am filing a complaint with the Secretary of State against the Clackamas County Commissioners for misappropriation of funds and illegal use of county employees work time.

More people = more media attention, so it is important for YOU, yes YOU, to be there. Please rsvp right now. I will email you a reminder Wednesday evening with the address and directions - it is about 10 minutes off of I-205. I expect it will only last 20 minutes or so - so a small investment of your time can have a huge impact on our political community.
The five candidates for commissioners CANNOT come. This is a grassroots effort to effect change, not a campaign opportunity and it is important that it not appear to be electioneering. However, supporters of the candidates are more than welcome to come to show their support. Please no candidate signage, buttons, or campaigning of any kind.
Flags and signs (other than candidate signs) are welcome. I would love to be surrounded by catchy slogans for the media to see, such as "Vote out the Incumbents" or "Stop Wasterful Spending". Use your imagination and be creative if you want to express yourselves for the cameras.
For those of you who may not be familiar with this effort, the Commissioners sent out a postcard mailing to all households and businesses in Clackamas County (and even some outside of the county limits) encouraging votes to vote Yes on Measures 66 and 67. This is in direct violation of the Oregon Revised Statutes. It is behavior like this that the grassroots - that is people like you and me - need to be vigilant about watching for and when we discover these outrageous abuses of power, that we go after these politicians and show them we are not going to tolerate it anymore.

RICO laws enforced could net $2 Bil fine!!!
Rather than a $75 fine, I suggest researching the application of RICO laws for these violations of State laws. I'm not a lawyer, however, my review of RICO leads me to conclude that it would/could apply. See these links:

RICO, with its treble damage awards, could change the game considerably. RICO claims are based upon damages. Violating campaign laws which result in increases of our taxes by millions of dollars could result in one very large RICO treble damages award. (Three times $800M tops $2B.)
Secondly: Executives of public organizations should be held liable for violations by their employees.
Corporations subject to claims of violation of laws such as antitrust, have required employees to regularly read and certify compliance with applicable laws. Corporate executives were held liable for violations by their employees. Compliance with campaign laws should be the responsibility of the executives of public organizations: state, county, schools, agencies and their employee unions and associations.
Thirdly: Oregon State campaign laws should be changed to impose more than a $75 slap on the wrist. And, the attorney general should be required to file charges for all violations.

AFP Feb 23 Rally 6:30p and Meeting 7pm RE Clackamas County
Clackamas AFP is officially calling on all Patriots to participate in a Tea Party beginning at 6:30pm Feb 23 to expose, publicize, and demand answers for the County Commission's shameful act of wasting our tax dollars to promote their own political objectives. In addition to this act, Chair Peterson has called on one of our own cities, Damascus, to dissolve itself in order to avoid the will of voters. Last week, the Commission also appropriated an additional 25 million dollars to Metro for a new light rail line that has been defeated by our voters.
We ask residents of Clackamas County to join us in person to rally outside and attend the presentation.
Time: Rally begins at 6:30pm, Tuesday, Feb 23. Meeting begins at 7pm.
Place: Red Soils Campus, 2051 Kaen Rd, 4th Floor Public Services Building, Oregon City
Bring: Signs, knowledge of the Commission's deeds, and questions for the commissioners.
Who: Clackamas County residents fed up with our County Commission not representing us and actively working against working Oregonians.

Chapter 399 Oregon Laws 2001
AN ACT
HB 2389
Relating to public officials; creating new provisions; and amending ORS 294.100.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 294.100 is amended to read:
294.100. (1) It is unlawful for any public official to expend any [money] moneys in excess of the amounts provided by law, or for any other or different purpose than provided by law.
(2) Any public official who expends any public [money] moneys in excess of the amounts[,] or for any other or different purpose [or purposes] than authorized by law[,] shall be civilly liable for the return of the money by suit of the district attorney of the district [where] in which the offense is committed, or at the suit of any taxpayer of such district, if the expenditure constitutes malfeasance in office or willful or wanton neglect of duty.
(3) On the demand in writing of 10 taxpayers of any municipal corporation with a population exceeding 100,000 inhabitants, filed with the tax supervising and conservation commission in the county in which the municipal corporation is situated, which demand sets forth that a public official [or public officials have] hasunlawfully expended [money] public moneys in excess of the [amounts] amount or for any other or different purpose [or purposes] than provided by law[,] and that the expenditure constitutes malfeasance in office or willful or wanton neglect of duty, the tax supervising and conservation commission shall make an investigation of the facts as to [such expenditures] the expenditure. If the tax supervising and conservation commission finds that public moneys have been unlawfully expended[,] and that the expenditure constitutes malfeasance in office or willful or wanton neglect of duty, the commission shall proceed at law in the courts against the public [officials who have] official who has unlawfully expended the moneys for the return of the moneys unlawfully expended to the treasury of the municipal corporation. A right of action hereby is granted to the tax supervising and conservation commission for [such purpose] the purposes of this section.
SECTION 2. (1) Except as provided in subsection (2) of this section, the amendments to ORS 294.100 by section 1 of this 2001 Act apply to all claims under ORS 294.100, whether arising before, on or after the effective date of this 2001 Act.
(2) The amendments to ORS 294.100 by section 1 of this 2001 Act do not apply to any claim under ORS 294.100 for which a judgment has been entered in the register of a court before the effective date of this 2001 Act.
